The success of assisted reproductive technologies (ARTs) worldwide has led to an accumulation of frozen embryos that are surplus to the reproductive needs of those for whom they were created. In these situations, couples must decide whether to discard them or donate them for scientific research or for use by other infertile couples. While legislation and regulation may limit the decisions that couples make, their decisions are often shaped by their religious beliefs. Unfortunately, health professionals, scientists and policy-makers are often (...) unaware of the way in which faith traditions view ART and decisions concerning the ‘fate’ of surplus embryos. In this paper scholars representing six major religious traditions provide a commentary on a hypothetical case concerning the donation or destruction of excess ART embryos. These commentaries provide a rich account of religious perspectives on the status of the human embryo and an insight into the relevance of faith to health and policy decisions, particularly in reproductive medicine, ART and embryo research. We contribute to the empirical debate on whether we understand and predict mental states by using simulation (simulation theory) or by relying on a folk psychological theory (theory theory). To decide between these two fundamental positions, it has been argued that failure to predict other people's choices would be challenging evidence against the simulation view. We test the specific claim that people prefer the rightmost position in choosing among equally valued objects, and whether or not this position bias can be (...) correctly predicted. A series of experiments shows that the bias appears only in a specific spatial arrangement and that it can be correctly predicted given adequate imaginative input. In concert with other recent findings on the correct prediction of choices these findings do actually strengthen, rather than challenge, the simulation account on the prediction of mental states. Das Buch beschreibt die Transformation des Diskurses der Kulturwissenschaft, der seit seinem Entstehen um die Jahrhundertwende auch die deutsch-jüdische Interkulturalität retten sollte, in einem Diskurs der politischen Theologie (Carl Schmitt und Gerschom Scholem), über den sich der katastrophale Trennungsprozess beider Kulturen vollstreckt.

Die Reihe Beitrage zur Altertumskunde (BzA) wurde 1990 begrundet. Sie enthalt vorwiegend deutschsprachige Monographien und Tagungsbande, jedoch auch Texte, Ubersetzungen und Kommentare von antiken Werken, die von bleibender Wirkung sind. Die einzelnen Bande der Beitrage zur Altertumskunde sind nutzliche Arbeitsinstrumente und bieten einen klaren Zuwachs an Erkenntnissen zur Altertumskunde. Pro Jahr erscheinen etwa acht Bande.

Theorists of public reason such as John Rawls often idealize constitutional courts as exemplars of public reason. This paper raises questions about the seduction and limits of analogies between theorists’ account of public reason and actual constitutional jurisprudence. Examining the work product of the United States Supreme Court, the paper argues that while it does engage in reason-giving to support its decisions—as the public reason strategy suggests— those reasons are (largely) legalistic and specifically juristic reasons—not the theorists’ idealized moral-political reasons (...) on matters of fundamental principle. But if constitutional courts do not engage on matters of fundamental principle, then a public reason strategy for assuaging democratic worries about judicial review would no longer be open: prominent liberal and deliberative democratic theorists could no longer point to the alleged superiority of constitutional courts to speak in the name of, and for, the people’s shared political principles. The paper extends beyond the U.S. case study by pointing to three institutional factors explaining the disanalogy between what some constitutional courts do and what public reason theories require them to do. It concludes with considerations about whether the public reason strategy might be more successfully applied to international courts. (shrink)

BackgroundAs hospitals have grown more complex, the ethical concerns they confront have grown correspondingly complicated. Many hospitals have consequently developed health care ethics programs (HCEPs) that include far more than ethics consultation services alone. Yet systematic research on these programs is lacking.MethodsBased on a national, cross-sectional survey of a stratified sample of 600 US hospitals, we report on the prevalence, scope, activities, staffing, workload, financial compensation, and greatest challenges facing HCEPs.ResultsAmong 372 hospitals whose informants responded to an online survey, 97% (...) of hospitals have HCEPs. Their scope includes clinical ethics functions in virtually all hospitals, but includes other functions in far fewer hospitals: ethical leadership (35.7%), regulatory compliance (29.0%), business ethics (26.2%), and research ethics (12.6%). HCEPs are responsible for providing ongoing ethics education to various target audiences including all staff (77.0%), nurses (59.9%), staff physicians (49.0%), hospital leadership (44.2%), medical residents (20.3%) and the community/general public (18.4%). HCEPs staff are most commonly involved in policy work through review of existing policies but are less often involved in development of new policies. HCEPs have an ethics representative in executive leadership in 80.5% of hospitals, have representation on other hospital committees in 40.7%, are actively engaged in community outreach in 22.6%, and lead large-scale ethics quality improvement initiatives in 17.7%. In general, major teaching hospitals and urban hospitals have the most highly integrated ethics programs with the broadest scope and greatest number of activities. Larger hospitals, academically affiliated hospitals, and urban hospitals have significantly more individuals performing HCEP work and significantly more individuals receiving financial compensation specifically for that work. Overall, the most common greatest challenge facing HCEPs is resource shortages, whereas underutilization is the most common greatest challenge for hospitals with fewer than 100 beds. Respondents’ strategies for managing challenges include staff training and additional funds.ConclusionsWhile this study must be cautiously interpreted due to its limitations, the findings may be useful for understanding the characteristics of HCEPs in US hospitals and the factors associated with these characteristics. This information may contribute to exploring ways to strengthen HCEPs. (shrink)

A socioeconomic and demographic analysis of U.S. Google Trends for queries about Business Ethics and Greed is proposed in the context of the 2008 financial crisis. The framework is grounded in the ethical decision-making literature. Two models using micro and macro-type variables are tested using GLM and GEE regression techniques. The frequency of these Google queries varies positively with the ratio of females, educational attainment, younger adult age, some measures of economic hardship or inequalities, and the lesser the weight of (...) the finance industry represented in each State. The frequency of queries intensifies for these same socioeconomic and demographic categories, in the aftermath of the financial crisis. This article is the first to study the salience of business ethics as an issue in the empirical literature using a nationwide database. It also provides a first empirical study in the specialized literature on “ethics in a time of crisis”. This study lays a preliminary groundwork to identify pro-ethical reform segments of the population, with practical use for financial regulatory agencies. (shrink)

Ambidextrous firms are those that can simultaneously manage exploitative and explorative innovation, which is why ambidexterity is key for firms that desire to pursue strategic entrepreneurship. Researchers have explored many of the reasons why some firms are more ambidextrous than others. However, little attention has been devoted to understanding how attributes of top decision makers can influence their firms' ambidexterity. By drawing on upper echelons theory and goal orientations research, we explain how firms' ambidexterity can be affected by top decision (...) makers' motivations in achievement situations. Testing our hypotheses on a sample of 274 top decision makers of firms in the United States, we find that top decision makers' learning goal orientation – their desire to take risks and maximize learning–has an inverted U-shaped relationship with ambidexterity while top decision makers' performance prove goal orientation – their desire to demonstrate competence with existing skills – has a U-shaped relationship with ambidexterity. These effects are weaker for top decision makers who have greater role experience. (shrink)

The party registration of tenure‐track faculty at 11 California universities, ranging from small, private, religiously affiliated institutions to large, public, elite schools, shows that the “one‐party campus” conjecture does not extend to all institutions or all departments. At one end of the scale, U.C. Berkeley has an adjusted Democrat:Republican ratio of almost 9:1, while Pepperdine University has a ratio of nearly 1:1. Academic field also makes a tremendous difference, with the humanities averaging a 10:1 D:R ratio and business schools averaging (...) 1.3:1, and with departments ranging from sociology (44:1) to management (1.5:1). Across all departments and institutions, the D:R ratio is 5:1, while in the “soft” liberal‐arts fields, the ratio is higher than 8:1. Gene editing in agriculture and food (GEAF) is a nascent development with few products and is unfamiliar among the wider US public. GEAF has garnered significant praise for its potential to solve for a variety of agronomic problems but has also evoked controversy regarding safety and ethical standards of development and application. Given the wake of other agribiotechnology debates including GMOs (genetically modified organisms), this study made use of 36 in-depth key interviews to build the first U.S. based typology of (...) proponent and critic priorities for shaping public trust in GEAF actors and objects. Key organizational actors provide early and foundational messaging, which is likely to contribute heavily to public salience, comprehension, and decision-making as potential consumers reflect upon their experiences, envision future outcomes, and consider the reputation of those trying to influence them. As is documented in our results, the trust-building priorities of these groups often stand in opposition to one another and are influenced by distinct motivations for how the public will come to trust or distrust GEAF actors and objects as more products are developed and enter the market. I argue, contrary to standard claims, that accomplice liability need not be a causal relation. One can be an accomplice to another’s crime without causally contributing to the criminal act of the principal. This is because the acts of aid and encouragement that constitute the basis for accomplice liability typically occur in contexts of under- and over-determination, where causal analysis is confounded. While causation is relevant to justifying accomplice liability in general, only potential causation is necessary in particular cases. I (...) develop this argument through the example of the role of U.S. legal officials in abetting the acts of unlawful interrogation that have taken place since 2001. The explosion of health-related costs in U.S. firms over more than a decade is a huge concern for managers. The initiation of Health and Safety programs at the firm level is an adequate Corporate Social Responsibility initiative to contain this evolution. However, in spite of their documented efficiency, firms underinvest in those programs. This appears as a puzzle for health economists. In this paper, we uncover a strong negative relation of financial leverage to the implementation of H&S programs. The negative (...) impact of debt on investment and CSR activities is generally interpreted as an efficient disciplinary effect of debt on managers. H&S are particularly well suited to revisit this evidence, given their strong profitability and homogeneity across firms. Very interestingly, the negative effect is stronger for firms with high free cash flows, for which debt is used to prevent overinvestment. This strongly suggests that debt, while disciplining managers, also discourages investments which are valuable both for firms and society. (shrink)

Research in the organizational sciences has tended to portray prosocial behavior as an unqualified positive outcome that should be encouraged in organizations. However, only recently, have researchers begun to acknowledge prosocial behaviors that help maintain an organization’s positive image in ways that violate ethical norms. Recent scandals, including Volkswagen’s emissions scandal and Penn State’s child sex abuse scandal, point to the need for research on the individual factors and situational conditions that shape the emergence of these unethical pro-organizational behaviors. Drawing (...) on trait activation theory, we argue that the “dark” trait of Machiavellianism should make individuals more willing to engage in UPB. Further, we argue that this willingness will be augmented when Machiavellians hold bottom-line-mentality climate perceptions, or the perception that ethical standards matter less than organizational performance. Using data from 170 U.S. employees, results suggested that Machiavellians are more willing to engage in UPB, but that BLMCPs may not affect their motivation to engage in UPB. We discuss the study’s theoretical and practical implications, as well as avenues for research. (shrink)

We investigate the association between a wide range of community-level environmental, social, and governance (ESG) outcomes and the credit risk of U.S. municipal finance fixed-income securities. We develop a novel dataset of multiple ESG outcomes for U.S. counties and connect it to a 2001-2020 panel of municipal bonds issued within those counties. Overall, we find supportive evidence that collective increases in community-level ESG factors (i.e., ESG outcomes) are associated with reductions in credit risk for U.S. municipal finance instruments over time. (...) We theorize that these associations arise from variations in investor perceptions and manifested changes in fiscal health over time as a function of changing ESG outcomes. Post hoc analyses leveraging quasi-exogenous shocks to uncertainty, as well as connecting ESG outcomes to various measures of fiscal health at the county-year level, and credit ratings at the bond-year level, help validate this theory. Our research suggests that even socially agnostic investors should investigate the environmental and social performance of a municipality as part of their credit due diligence. (shrink)

BackgroundTo help inform the development of more accessible, acceptable, and effective ethics consultation (EC) training programs, we conducted an EC training needs assessment, exploring ethics practitioners’ opinions on: the relative importance of various EC practitioner competencies; the potential market for EC training (that is, how many individuals would benefit and how much individuals and hospitals would be willing to pay); and the preferred content, format, and characteristics of EC training.MethodsAs part of a multipart study, we surveyed “best informants” who self-identified (...) as the person most actively involved in EC or healthcare ethics in a random sample of 600 U.S. general hospitals, stratified for bed size.ResultsThe competency that was ranked most important for a lead or solo ethics consultant was knowledge of ethics, while common sense was ranked least important. The median estimated number of individuals at each hospital who would benefit from EC training was six at the basic level, three at the advanced level, and two for EC management training. In 19.1 percent of hospitals, respondents thought their hospital would not be willing to pay anything for EC training within the next two years. Respondents thought potential trainees would be likely to participate in EC training on multiple different topics. Opinions varied widely on preferred formats. Most respondents thought it very important to be able to interact with instructors and with other trainees, practice EC skills, receive a certificate for completing EC training, and complete EC training during work hours.ConclusionsThese findings provide U.S. population data that may be useful to healthcare educators and bioethics leaders in their efforts to develop EC training programs and products that match trainees’ preferences and needs. This paper describes the use and analysis of the Simulator for Engineering Ethics Education to perform cross culture engineering ethics training and analysis. Details describing the first generation and second generation development of the SEEE are published in Chung and Alfred, Science and Engineering Ethics, vol. 15, 2009 and Alfred and Chung, Science and Engineering Ethics, vol. 18, 2012. In this effort, a group of far eastern educated students operated the simulator in the instructional, training, scenario, and evaluation modes. The (...) pre and post treatment performance of these students were compared to U.S. Educated students. Analysis of the performance indicated that the far eastern educated student increased their level of knowledge 23.7 percent while U.S. educated students increased their level of knowledge by 39.3 percent. Lack of high-speed internet access remains a problem in the United States, particularly in rural areas, Tribal lands, and the U.S. territories. High-speed internet should be considered a basic right because it connects people to social media, the new public sphere. Critics worry about the politically polarizing effects of online social media, but its ability to unify, connect, and shape policy decisions should also be taken into account. Engaging with Jürgen Habermas’s early work on the public sphere, I argue that (...) the technical and cultural extension of access to social media can realize Kant’s vision of the public sphere as a bridge between morality and politics. This paper examines the impact on firm value created by investor reaction to same day news of corporate social responsibility and corporate social irresponsibility activities. First, using trading volume, the authors establish that the perceived value of moral capital generated by news involving institutional stakeholders is less clear to investors than that of the news involving technical stakeholders. Subsequently, the authors analyze abnormal returns from 565 unique firm events—each comprising at least one positive and one negative stakeholder news item. Using (...) signaling theory, the authors demonstrate that news of the number of CSR activities involving institutional groups counteracts the effects of same day CSiR news in an inverted U-shaped fashion. In contrast, they find that news of the number of CSR activities involving technical groups mitigates the effects of same day CSiR news in a U-shaped fashion. (shrink)

The annual volume of ethics consultations (ECs) has been a topic of interest in the bioethics literature, in part because of its presumed relationship to quality. To better understand factors associated with EC volume, we used multiple linear regression to model the number of case consultations performed in the last year based on a national survey. We found that hospital bed size, academic affiliation, and urban/rural location were all associated with EC volume, but were not the primary drivers. Instead, these (...) variables affected EC volume through three other variables, all of which relate to ethics staffing: the percentage of case consultations performed by a single individual; whether the survey respondent’s main role at the hospital contained the word “ethics”; and especially, the number of full-time ethics program staff. We conclude that EC is an example of supply-sensitive care, and further research is needed to determine the optimal level of EC activity. (shrink)

Corporate misconduct receives significant attention in the business ethics literature. This paper studies how corporate misconduct is impacted by import penetration from China, which is largely exogenous to the U.S. product market. Using this natural experiment, we find that heightened Chinese import penetration curbs corporate misconduct of U.S. firms. The effect is more pronounced for firms with weaker corporate governance and firms more vulnerable to product market competition. The findings provide implications for firms facing increased import penetration. Firms may consider (...) improving corporate governance and exploring avenues for differentiation as potential strategies to cope with the competition. In addition, we address the exogeneity concern derived from the influence of Chinese value penetration. Furthermore, we find that competition-related policies such as tariff reduction and U.S. granting China Permanent Normal Trade Relations (PNTR) status also lower corporate misconduct. Our work adds to the debates on competition and corporate misconduct in a cross-country competitive landscape. (shrink)

Die Erkenntnistheorie wird meist als Theorie des Wissens charakterisiert. In jüngerer Zeit ist der alleinige Fokus auf Wissen kritisiert und sind weitere epistemische Güter diskutiert worden. Verstehen und Weisheit sind von besonderer Bedeutung. Erstens ist Verstehen ein hohes und Weisheit vielleicht das höchste epistemische Gut; beide scheinen epistemisch wertvoller zu sein als Wissen (Riggs 2003). Zudem ist unklar, ob der epistemische Wert von Wissen den Wert seiner Bestandteile (z.B. wahre, gerechtfertigte Meinung) übersteigt. Es ist behauptet worden, dass sich für Verstehen (...) kein solches Wertproblem stellt und die Erkenntnistheorie deshalb Verstehen ins Zentrum rücken sollte (Kvanvig 2003; Pritchard 2010). Zweitens ist Verstehen ein Ziel von Wissenschaft (Elgin 2017) und von wissenschaftlicher Erklärung (Friedman 1974). Theorien der Erklärung und der kognitiven Leistungen der Wissenschaft verlangen deshalb nach einer Theorie des Verstehens (de Regt u.a. 2009). Drittens mag ein geeigneter Begriff des Verstehens es erlauben, tiefsitzende Intuitionen zur epistemischen Rechtfertigung anzuerkennen, die für Wissen zurückgewiesen wurden, z.B. internalistische und kohärentistische Intuitionen sowie solche zur Rolle von intellektuellen Charaktertugenden (Riggs 2003; Zagzebski 1996). Diese Idee ist kürzlich kritisiert (z.B. Greco 2014) und dafür vorgeschlagen worden, dass solche Intuitionen Merkmale von Weisheit betreffen (Grimm u.a. 2017, Kap. 10). Osama bin Laden means well. This is evident from his declarations, juridical decrees, lectures, epistles, and written reminders, which Bruce Lawrence has made available in Messages to the World: The Statements of Osama Bin Laden a single volume. Duty, Osama claims, compels Muslims' support for jihad against the???Crusader???Jewish Alliance???. But many attack his goals and behavior as immoral. Initiatives he has supported or directed represent his strategy for fulfilling his duty and demonstrate its apparent immorality at the same time: notably, (...) attacks on U.S. embassies, the 9/11 attacks, and more recently an alleged plot to detonate hydrogen peroxide bombs in public transportation venues. Moreover, his willingness to kill innocents generally is self-evidently wrong, as is his blanket hatred of Jews, Americans, and Christians ; although on one occasion he has declared that???many in the West are polite and good people???. Since the time of Aristotle, metaphysics has been an ill-defined term. This paper defines it as a logically idempotent metalinguistic identity of reality which couples the two initial ingredients of awareness: perceptual reality (the basis of physics), and cognitive-perceptual syntax, a formalization of mind. The explanation has been reduced to a few very simple, clearly explained mathematical ingredients. This paper contains no assumptions or arguable assertions, and is therefore presented as an advanced formulation of logic which has been updated for (...) meaningful reference to the structure of reality at large. This structure, called the Cognitive-Theoretic Model of the Universe or CTMU, resolves the problems attending Cartesian dualism by replacing dualism with the mathematical property of self-duality, meaning (for reality-theoretic purposes) the quantum-level invariance of identity under permutation of objective and spatiotemporal data types. The CTMU takes the form of a global coupling or superposition of mind and physical reality in a self-dual metaphysical identity M:L<-->U, which can be intrinsically developed into a logico-geometrically self-dual, ontologically self- contained language incorporating its own medium of existence and comprising its own model therein. English summary: The relationship of art to physical violence in European cultural history has always been intricate. Aestheticised violence in the fine arts, on the stage or in literature has often been discredited, but at the same time - not least because of the contiguity of violence and sexuality - it is received with pleasure. In a survey of literary examples from antiquity, the Renaissance and modernity, the author begins by elucidating the development in Europe of the troubled relationship between (...) aesthetics and violence. This relationship is then examined from a psychoanaltical angle in two exemplary studies of music. The dual perspective continues with the analyses of contemporary cultural producers (a theatre director, a photographic artist and a film director) together with those of cultural scientists (from theatre studies, art history, and film and media studies). In this way, the actual process of aesthetisizing violence, on the one hand, and theoretical reflections on it, on the other, become clear.German description: Das Verhaltnis der Kunste zur physischen Gewalt ist in der europaischen Kulturgeschichte immer schon ein intrikates gewesen. Asthetisierte Gewalt in der Kunst, auf der Buhne oder in der Literatur wurde zwar oft diskreditiert, zugleich aber - auch wegen der Nahe von Gewalt und Sexualitat - mit Genuss rezipiert. An den Beispielen der Literatur der Antike, der Renaissance und der Moderne zeigt der Band die europaische Entwicklung des ambivalenten Verhaltnisses von Asthetik und Gewalt auf. ACTION-THEORETICALLY EXPLANATORY INTERPRETATIONS AS A MEANS OF SEMANTIC MEANING ANALYSIS The article first develops a general procedure for semantic meaning analysis in difficult cases where the meaning is very uncertain. The procedure consists of searching for one or more possible hypothetical causal explanations of the text, these explanations containing, among other things, the semantic intention of the author, his subjective reasons for this meaning and for the writing down of the text, but also the path of transmission of the text (...) from the writing down to the respective present text version. These hypothetical explanations (interpretations) are deductive-nomological or probabilistic, therefore presuppose corresponding general law hypotheses. If there is only one possible (hypothetical) explanation of the text at hand, this hypothetical explanation is also true. Very often, however, there are several possible explanations. In this case, the probabilities of these possible explanations must be determined; these probabilities then carry over to the individual hypotheses in the explanation (according to Bayes' law). This general procedure of meaning analysis is used in the second part of the article to reconstruct two famous interpretations (by Wapnewski and Hahn) of a poem by Walther von der Vogelweide ("Nemt, frowe, disen kranz"). -/- GERMAN ABSTRACT In dem Artikel wird zunächst ein allgemeines Verfahren zur semantischen Bedeutungsanalyse in schwierigen Fällen entwickelt, in denen die Bedeutung sehr unsicher ist. Das Verfahren besteht darin, daß eine oder mehrere mögliche hypothetische kausale Erklärungen des Textes gesucht werden, wobei diese Erklärungen u.a. die semantische Intention des Autors enthalten, seine subjektiven Gründe für diese Bedeutung und für die Niederschrift des Textes, aber auch den Weg der Tradierung des Textes von der Niederschrift bis zur jeweils vorliegenden Textversion. Diese hypothetischen Erklärungen (Deutungen) sind deduktiv-nomologisch oder probabilistisch, setzen deshalb entsprechende allgemeine Gesetzeshypothesen voraus. Wenn es nur eine mögliche (hypothetische) Erklärung des vorliegenden Textes gibt, ist diese hypothetische Erklärung auch wahr. Sehr häufig gibt es aber mehrere mögliche Erklärungen. In diesem Fall müssen die Wahrscheinlichkeiten dieser möglichen Erklärungen bestimmt werden; diese Wahrscheinlichkeiten übertragen sich dann auch auf die einzelnen Hypothesen in der Erklärung (nach dem Bayesschen Gesetz). Dieses allgemeine Verfahren der Bedeutungsanalyse wird im zweiten Teil des Artikels zur Rekonstruktion zweier berühmter Interpretationen (von Wapnewski und Hahn) eines Gedichts von Walther von der Vogelweide („Nemt, frowe, disen kranz“) verwendet. Der vorliegende Band versammelt Beiträge zu ihren vorsokratischen Anfängen, zu Platon und Aristoteles als den unumstrittenen Protagonisten sowie zu den hellenistischen Schulen, berücksichtigt aber genauso auch kaiserzeitliche, spätantike und frühislamische Denker. Das antike Nachsinnen über Politik wird in seiner ganzen historischen Breite und in seiner ungebrochenen Aktualität vorgestellt. Due to the ethical breaches of tobacco companies over a 50-year period, a U.S. Court ruled in United States v. Philip Morris USA, Inc. that major U.S. tobacco companies had misled consumers and the government about tobacco’s addictiveness, effects of environmental smoke, marketing targeted at adolescents, and deceptive practices related to harmfulness of smoking. We address the actions of the tobacco companies based on the consumer’s right to be informed and values for ethical corporate behavior, and we draw from psychological (...) theories and the smoking literature to develop our conceptual framework and test the effectiveness of the ensuing corrective advertising campaign mandated in the Court decision. We use a quota sample of 470 smokers and non-smoker participants in a longitudinal study to test the impact of the corrective advertising campaign on key antismoking beliefs from the campaign. Results reveal that the corrective ad campaign has not been successful in affecting smokers’ or non-smokers’ antismoking beliefs. However, differences are found between smokers’ and non-smokers’ beliefs about the adverse health effects of smoking, effects of secondhand smoke, and tobacco company deceptiveness, with these beliefs being stronger for non-smokers. Smokers’ weaker beliefs about the effects of secondhand smoke are viewed as particularly problematic, given the established health risks. We address the implications of the ethical breaches and the corrective advertising attempt to address the deception identified by the Court. (shrink)

Zunächst werden die Kernthesen von Habermas' Diskursethik vorgestellt, insbesondere der Universalisierungsgrundsatz U und das diskursethische Prinzip D. Eine ausführliche Analyse zeigt dann, daß Habermas' Argumentationen für diese Prinzipien in mehrfacher Hinsicht ungültig sind. Die Betrachtung früherer Varianten dieser Argumentationen und späterer Kommentare Habermas' macht zudem eine gewisse Wendung Habermas' weg von der Transzendentalpragmatik hin zum Intuitionismus und eine Abschwächung seines Begründungsanspruchs bis hin zu dessen Annullierung deutlich. Eine Kritik an vier Interpretationen von U selbst und an den beiden Hauptinterpretationen von (...) D erweist diese Moralkriterien als in vielerlei Hinsicht unbrauchbar und als bloß formelhafte Vereinigung schwer zu vereinender Ideale. (shrink)

In March 2004, the U.K. government announced its intention to grant limited authorization for the growing of commercial genetically modified (GM) crops. This article reviews the potential liabilities that may arise from GM cropping, for environmental damage and for economic losses claimed by non-GM producers. It considers the application of the European Community (EC) Environmental Liability Directive of 2004 to genetically modified organisms (GMO) releases, and the proposed statutory scheme for the coexistence of GM and non-GM agriculture in England and (...) Wales. It also examines the application of the common law of nuisance to the release of GMOs and considers the relevant case law of the English courts. Although there will be a residual role for liability at common law following the establishment of a statutory coexistence scheme, the article highlights a number of formidable problems facing attempts to establish claims for liability arising from GMO releases at common law.
